TATTOO PURCHASE, BOOKING & CANCELLATION POLICY

This policy applies to one-off flash tattoos purchased through the Palm Black online store. By completing checkout, you confirm that you have read and accepted this policy.

1. What you are purchasing

Your payment includes the complete in-studio tattoo by the artist named on the product page, at the listed size selected during checkout.

The purchase reserves the design exclusively for you. Once tattooed, the design will be permanently retired and will not be repeated.

No physical or downloadable artwork is supplied. Copyright and reproduction rights remain with the artist, and the design may not be taken to another artist or studio.

If an order is cancelled and refunded before the tattoo is completed, Palm Black may release the design and make it available for purchase again.

2. Larger sizes and additional charges

The price paid at checkout covers the listed size selected.

If you request a size larger than the available options, the artist will confirm whether the requested size is suitable and advise you of the additional cost. 

If you decide not to proceed with the larger size, the tattoo can still be completed at the listed size originally purchased.

3. Booking your appointment

Completing checkout reserves the design but does not confirm an appointment date.

Palm Black reception will contact you using the information supplied with your order to arrange an appointment, subject to the artist’s availability.

You are responsible for providing accurate contact details and responding to Palm Black’s booking communication.

Your appointment must be booked within six months of purchase and scheduled to take place within 12 months of purchase, unless Palm Black agrees to an extension in writing.

If Palm Black or the artist cannot reasonably accommodate your appointment within this period, the booking period will be extended or you may request a refund without a cancellation charge.

If you do not respond or make reasonable arrangements to book your appointment, Palm Black may send a final written notice and treat the order as a client cancellation. The design may then be released, and any refund will be handled under the cancellation provisions below.

4. Age and identification

You must be at least 18 years old to receive the tattoo.

Valid government-issued photographic identification must be presented at your appointment. Palm Black will not tattoo anyone under 18, even with parental consent.

5. Placement and design adjustments

Body-placement images are visual examples only. Final scale, proportions and appearance will vary according to anatomy, skin and placement.

Alternative placements can be discussed, but the artist must confirm that the chosen area is suitable for the design.

Minor adjustments may be requested, provided the tattoo remains substantially true to the original artwork. Major alterations, a substantially different composition or a complete redraw are not included and may require a separate quote.

The artist retains final discretion over adjustments needed to protect the quality, clarity and longevity of the tattoo.

6. Health, safety and consent

All tattoo appointments are subject to Palm Black’s standard consent process and an in-person safety assessment.

You must disclose any relevant medical conditions, medication, allergies or other information that could affect the safety of the tattoo procedure.

Palm Black and the artist reserve the right to refuse or postpone the procedure where tattooing would be unsafe, inappropriate or unlawful.

7. Rescheduling with more than 48 hours’ notice

Appointment changes must be requested more than 48 hours before the scheduled starting time.

No late-rescheduling charge will apply where sufficient notice is provided. A replacement appointment remains subject to the artist’s availability and the booking-period requirements above.

8. Late cancellations and rescheduling

If you cancel or reschedule within 48 hours of the appointment, R1,400 from your original payment will be applied as a late-cancellation charge and will no longer form part of your tattoo credit.

The remaining amount will stay credited toward the tattoo. A replacement R1,400 payment must be made before another appointment is confirmed.

In practical terms, R1,400 of the original payment is forfeited and must be replaced if you wish to rebook.

9. No-shows

Failure to attend a confirmed appointment without notice will be treated in the same way as a cancellation within 48 hours.

50% from the original payment will be applied as the no-show charge. The remaining amount will stay credited toward the tattoo, and a replacement 50% payment will be required before rebooking.

If you decide not to rebook, the remaining balance will be refunded, subject to applicable consumer law.

10. Order cancellations and refunds

All cancellation and refund requests must be submitted to Palm Black in writing.

Where permitted by law, Palm Black may deduct a reasonable cancellation charge based on:

• The notice provided

• Work already completed

• The period for which the one-off design was reserved

• The likelihood of finding another client for the design or appointment

• Any reasonable losses resulting from the cancellation

The remaining balance will be refunded to the original payment method.

Where a R1,400 late-cancellation or no-show charge has already been applied, Palm Black will not deduct the same charge twice from the same missed appointment.

No cancellation charge will be imposed where prohibited by applicable law, including qualifying circumstances involving death or hospitalisation.

Any applicable statutory cooling-off and refund rights remain unaffected by this policy.

11. Complimentary touch-up

One complimentary touch-up is included where the artist determines that it is reasonably required.

You must contact Palm Black within three months of the original tattoo appointment to request the touch-up. The touch-up appointment may take place later, subject to availability, provided the request was submitted within this period.

Complimentary touch-ups do not cover:

• Changes or additions to the original design

• Damage caused by inadequate aftercare

• Picking, scratching or accidental injury

• Excessive sun exposure

• Fading or ink loss caused by placement, lifestyle or failure to follow the provided aftercare instructions

The artist will make the final assessment regarding whether a complimentary touch-up is appropriate.

12. Artist or studio cancellation

If Palm Black or the artist needs to reschedule your appointment, no rescheduling charge will apply.

If Palm Black becomes permanently unable to complete the tattoo, you may choose an appropriate alternative arrangement or receive a refund for the unperformed service without a cancellation charge.

13. Statutory rights

Nothing in this policy is intended to exclude, restrict or replace any rights granted to you under applicable South African consumer law.
